Please read and understand all the information on this page. By booking a Skican holiday you will enter into agreements with Skican Ltd. and with others who provide your holiday services.
DEPOSIT AND PAYMENT SCHEDULE
Payment can be made by American Express, Visa or Mastercard.
Deposit: $500 per person is required at time of booking for standard packages. Standard packages include land packages and packages with air covered by Skican’s standard Air Canada contracts. For non-standard packages, a Skican representative will confirm the deposit required at time of booking.
Balance of Payment: Final payment on all bookings is required no later than 65 days prior to departure date.
Bookings within 65 Days of Departure: Full payment required at time of booking.
Changes to standard packages: a deviation fee of $100 per person will apply in addition to any change in airfare or other package components plus applicable surcharges.
CHARGES FOR CANCELLATION
Charges may differ for holiday season, Presidents Week, March Break and for non-standard packages.
Note: name changes are not permitted by airlines.
Unused tour features are non refundable.
Revisions to Accommodation and Departure Dates:
CONDITIONS ON CHILDREN RATES Children rates are available only at participatng resorts and are subject to specific resort and accommodation requirements. If additional beds (cribs, cots) are required there may be an additional charge.

Terms and Conditions of Use
The following terms and conditions apply to your pre-paid Skican Gift Card Please keep a copy for your records. The use of your Skican Ltd. Card by yourself or by anyone who holds your card, constitutes your acceptance of these terms and conditions.
Use of Pre-Paid Card for Skican Ltd. Purchases
Your Skican Card can only be used for the purchase of products sold by Skican Ltd. You can purchase pre-set dollar amounts, e.g. $50, $100, $200, $500, or $1,000, or you can load another dollar value onto your Skican Card. The amount that you load onto your Skican Card is a pre-payment only for products sold by Skican Ltd. No credit card, credit line, overdraft protection or deposit account is associated with your Skican Card. The amount on your Skican \Card is non-refundable and cannot be redeemed for cash, unless required by law. At no time shall any dividend, interest or earnings of any kind whatsoever be accrued, credited or paid to you on the amounts loaded onto a Skican Card. The amount loaded onto your Skican Card is not insured by the Canadian Deposit Insurance Corporation (CDIC).
Skican reserves the right not to accept, load or re-issue any Skican Card and to otherwise limit the use of a Skican Card if Skican Ltd. reasonably believes that the use is unauthorized, fraudulent, or otherwise unlawful.
Purchasing, and Loading Your Skican Card
You can purchase/load your Skican Card by contacting a sales associated with Skican Ltd.
Skican Cards can only be activated by Skican Ltd and cannot be activated online. However, when a Skican Card is purchased online, it will be activated and ready for your use when it is sent to you. Any amount loaded, whether at a participating Skican location in Canada or online, will appear on your Skican Card immediately. The minimum amount that can be loaded onto a Skican Card is CDN $50.00 up to a maximum of CDN $1,000.00. Skican Ltd., in its sole discretion, may change the maximum or minimum amounts that may be loaded onto your Skican Card at any time and any changes to these amounts will be posted at www.Skican.com.
Card Service Fees and Expiration
Skican Ltd. does not charge any service fees relating to the issuance, activation or use of your Skican Card. Your Skican Card will not expire.
Receipts and Statements
You will not be sent statements of itemized transactions relating to your use of your Skican Card. You can check the balance of your Skican Card by calling 1-888-475-4226. Your Skican Card balance will also appear on your receipt when you make a purchase with your card at Skican Ltd.
Billing Errors, Corrections
Skican Ltd. reserves the right to adjust and correct the balance on your Skican Card in the event we reasonably believe that an administrative, accounting or billing error has occurred. If you have questions regarding any Skican Card transactions or any correction, or if you dispute any transaction or correction that has been assessed against your Skican Card, please call 1-888-475-4226. Skican Ltd. shall have no responsibility for any billing error unless you provide us with notice within sixty (60) days of the date of the transaction in question. Please monitor your transactions and card balances closely.
Liability for Unauthorized Transactions
You will be responsible for all transactions relating to your Skican Card, whether authorized or not. You will not be entitled to a refund of any kind in the event your Skican Card is lost, misplaced or stolen.

Amendments to this Agreement
We may amend these terms or conditions at any time, including any rights or obligations you or we may have. We will post the amended terms and conditions on www.Skican.com. As permitted by applicable law, any amendment will become effective at the time it is posted on www.Skican.com. Unless we state otherwise, the amended terms and conditions will apply to future and existing Skican Cards. You are deemed to accept the amendments if (1) you do not notify us to the contrary in writing within thirty (30) days of the date the amendments are posted on www.Skican.com, or (2) you use your Skican Card after such notice is posted.
Suspension or Termination
We may suspend or terminate the Skican Card program in whole or in part at any time and for any reason without notice If we terminate the program without cause, we will refund the balance held on your Skican Card or issue location credits equal to that balance.
Governing Law
This program shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, notwithstanding any conflict of law rules.
Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS RIGHTS THAT YOU MAY OTHERWISE HAVE. IT PROVIDES FOR RESOLUTION OF DISPUTES ARISING OUT OF THE SKICAN CARD PROGRAM THROUGH ARBITRATION INSTEAD OF COURT TRIALS AND CLASS ACTIONS. ARBITRATION IS FINAL AND BINDING AND SUBJECT TO ONLY VERY LIMITED REVIEW BY A COURT.
Binding Arbitration
This provision is intended to be interpreted broadly to encompass all disputes or claims arising out of our relationship. Any dispute or claim made by you against Skican Ltd. (or against any of our subsidiary, parent or affiliate companies) arising out of or relating to the use of the Skican Card (whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory) will be resolved by binding arbitration.
Arbitration Procedures
You must first present any claim or dispute to Skican Ltd. by contacting our Customer Relations Department to allow us an opportunity to resolve the dispute. You may request arbitration if your claim or dispute cannot be resolved within sixty (60) days. The arbitration of any dispute or claim shall be conducted in accordance with the Arbitrations Act (Ontario) as modified by this Agreement. Unless you and Skican Ltd. agree otherwise, any arbitration will take place in Toronto, Ontario, and will be conducted in the English language. An arbitrator may not award damages other than actual damages, except that the arbitrator may award on an individual basis damages required by statute and may order injunctive or declaratory relief pursuant to any applicable consumer protection statute. Any arbitration shall be confidential, and neither party may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement of the arbitration award. Judgment on any arbitration award may be entered in any court having proper jurisdiction. If any portion of this arbitration clause is determined by a court to be inapplicable or invalid, the remainder shall still be given full force and effect.
Costs of Arbitration
All administrative fees and expenses of arbitration will be divided equally between the parties In all arbitrations, each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration.
Disclaimers and Limits of Liability
SKICAN LTD. MAKES NO REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE SKICAN CARD. SKICAN LTD. DOES NOT REPRESENT OR WARRANT THAT YOUR SKICAN CARD WILL ALWAYS BE ACCEPTED OR THE SKICAN CARD PROGRAM WILL ALWAYS BE ACCESSIBLE. IN THE EVENT THAT SKICAN LTD. OR ITS AFFILIATES ARE FOUND LIABLE, YOU SHALL ONLY BE ENTITLED TO RECOVER ACTUAL AND DIRECT DAMAGES AND SUCH DAMAGES SHALL NOT EXCEED THE LAST BALANCE HELD ON YOUR SKICAN CARD PRIOR TO THE TIME AT WHICH SUCH DAMAGES AROSE. SKICAN LTD. AND ITS AFFILIATES SHALL HAVE NO LIABILITY FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES IN NO EVENT SHALL SKICAN LTD. OR ITS AFFILIATES HAVE ANY LIABILITY FOR UNAUTHORIZED ACCESS TO, OR ALTERATION, THEFT OR DESTRUCTION OF A SKICAN CARD THROUGH ACCIDENT, MISUSE, OR FRAUDULENT MEANS OR DEVICES OR AS A RESULT OF ANY DELAY OR MISTAKE RESULTING FROM ANY CIRCUMSTANCES BEYOND OUR CONTROL.
